HAND-PAINTED OIL PAINTING
TERMS & CONDITIONS
1. Nature of the Artwork

All oil paintings are hand-painted, original artworks created by a human artist using traditional oil painting techniques.

The artwork is not a photorealistic or AI-generated replica of the reference photo. It is an artistic interpretation, not an exact duplication.

Likeness, mood, colour, and composition will be interpreted through the artist’s personal style and brushwork.

Variations in facial details, proportions, texture, and colour are normal and expected in hand-painted art and do not constitute defects or inaccuracies.

By placing an order, the client acknowledges and accepts that the final artwork will reflect artistry rather than photographic precision.

2. Booking & Payment

A 30% non-refundable deposit is required to secure the booking and lock in the current price.

Prices are not guaranteed without a deposit. If a deposit or full payment is not received, any future price increase may apply.

The remaining 70% balance must be paid in full on or before the booked date provided by the client (e.g. wedding or event date).

Work will not begin until full payment has been received.

3. Reference Photos

Clients must provide clear, high-quality reference photos.

Adelaide Fleur is not responsible for limitations in likeness or detail caused by low-resolution, cropped, or poorly lit images.

Artistic enhancements may be applied to improve overall composition and harmony.

4. Timeline
-
Estimated completion time is 8–12 weeks from the day photograph sent to Adelaide Fleur by customer.

Timelines may vary due to artistic complexity, workload, or unforeseen circumstances.

Rush orders may be available upon request and subject to additional fees.

5. Artist Collaboration & Signature

Artworks are created by a trusted partner artists collaborating with Adelaide Fleur. The artist’s identity remains private unless otherwise stated.

Paintings may carry the artist’s signature, Adelaide Fleur branding, or both, depending on the agreed format.

6. Cancellation & Refunds
-
The 30% deposit is strictly non-refundable and is required to secure the booking, lock in the current price, and reserve the artist’s time and materials.

Payments (including the remaining balance) will not be refunded after the booked date has passed. By this time, work on the artwork will have already commenced, including planning, material preparation, and scheduling of the artist. As each artwork is custom-made specifically for the client and their event, it cannot be resold or reused. This policy ensures fairness to both the artist and the client while reflecting the bespoke nature of the service.

If the client changes their mind before the booked date, they may choose once to either reschedule the order for themselves or transfer it to a new customer (for example, a friend or family member). This must be done within 6 months from the original booked date and is subject to approval by Adelaide Fleur, with the original booked price honored. No further reschedules or transfers will be allowed after this.

In the unlikely event that Adelaide Fleur is unable to complete the artwork due to unforeseen circumstances, the client will receive a full refund of all payments made.

7. Shipping & Delivery

Shipping fees are not included unless stated otherwise.

Local pick-up in Adelaide is available at no additional cost, while interstate orders are shipped in a protective rolled tube for safety, with the option to have the artwork stretched on canvas prior to shipping for an additional fee; shipping costs are not included unless stated, and while Adelaide Fleur ensures secure packaging, we are not responsible for delays or damage caused by third-party couriers, though shipping insurance can be arranged upon request.

8. Intellectual Property & Usage

Adelaide Fleur reserves the right to use images or videos of the artwork for portfolio, website, and social media purposes, unless privacy is requested in writing.

Copyright remains with the artist and Adelaide Fleur.

Clients receive personal display rights only; commercial reproduction is prohibited without written consent.

9. Acceptance of Terms

By paying the deposit and balance, the client confirms that they have read, understood, and agreed to these Terms & Conditions.
